Introduction

The Buffalo AKG Art Museum (“the Organization”) provides www.buffaloakg.org (“the Website”) and its subdomains in support of the Organization's mission to flourish as an exceptional hub of artistic and creative energies that enriches and transforms people’s lives in our community, our nation, and the world. Visitors to the Website agree to the following terms of use, which the Organization may revise, at its discretion, at any time.

Acceptance of Terms

By accessing and using the Website and its subdomains, you fully acknowledge and accept the following terms, including any additional or updated rules or regulations that the Organization may post here or on individual pages. Users are encouraged to visit this page from time to time to review current terms of use, as these may change in the future.

Copyright and Proprietary Rights

All content on the Website and its subdomains, including but not limited to text, images, trademarks, data, audio files, video files and clips, software, and documentation or other information (collectively, “the Content") is proprietary to the Organization or its licensors. The Organization retains all rights, including copyright, in the Content. Copyright and other proprietary rights may be held by individuals or entities other than, or in addition to, the Organization. No part of the Content may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, or otherwise, without the written permission of the Organization.

The Organization is committed to complying with U.S. copyright and related laws, and requires all users of the Website and its subdomains to comply with these laws. Owners of copyrighted works who believe that their rights under U.S. copyright law have been infringed should contact the Organization immediately to report any concerns.

Trademarks and Logos

Many of the trademarks, service marks, and logos displayed on the Organization’s Website and its subdomains are registered and/or unregistered marks of the Organization. The trademarks of third parties may also be displayed on the Organization’s Website and its subdomains. No trademark or logo displayed on the Website and its subdomains can be used in any way or reproduced in any manner without the express written permission of the Organization and/or any third-party owner. Any unauthorized use of trademarks or logos displayed on the Website is strictly prohibited.

Authorized Uses

The Content is made available for limited non-commercial, educational, and personal use only, or for fair use as defined by United States copyright laws. Visitors may download files from the Website and its subdomains for their own use, subject to any additional terms or restrictions that may be applicable to individual files. Visitors must, however, cite the author and source of the Content as they would from any printed work, and the citations should include the URL "www.buffaloakg.org," but not in any way that implies endorsement of the user or his or her use of the materials. All visitors agree that they will limit their use of such files to non-commercial, educational, personal, or fair use, and will not violate the Organization's or any other party's proprietary rights. Visitors may not remove any copyright, trademark, or other proprietary notices, including without limitation attribution information, credits, and copyright notices that have been placed on or near the Content by the Organization. Downloading, printing, copying, distributing, or otherwise using materials for commercial purposes, including commercial publication or personal gain, is expressly prohibited. 


Images of Works of Art

As a part of the Website and its subdomains, the Organization has provided a number of images that may be downloaded only for limited non-commercial, personal, and educational use (including scholarly publishing), or for fair use as defined by United States copyright laws. If the Organization believes an artwork is in the public domain and free of other restrictions, digital photographic images of the artwork have been made freely available on the Website. Not every work of art in the Organization’s collection is in the public domain, nor is every image on the Website free of restrictions. Certain digital photographic images of artwork are covered by claims to copyright as noted in the captions for individual works. Although the Organization has made every effort to identify and credit the source and ownership of all images made available on the Website, visitors are responsible for fully researching the current copyright status of individual images they may wish to use. All visitors must cite the creator and source for downloaded images, and must follow all applicable copyright laws.

The Organization does not warrant that use of the Content displayed on the Website and its subdomains will not infringe the rights of third parties not owned by or affiliated with the Organization. The Organization is mindful of its responsibilities concerning the intellectual property rights of others, and works to protect images of artworks that are believed to be under copyright or to have other restrictions imposed by contract or policy. The copyright of a work of art itself is distinct from any rights of the photograph/digital image depicting the work (where applicable) and may be held by individuals or entities other than the Organization. This information, if known by the Organization, can be found clearly displayed under the image on each object record.

Anyone wishing to use the Content from the Website and its subdomains for purposes other than as authorized herein must obtain prior written approval. Permission for such use is granted on a case-by-case basis at the sole discretion of the Organization and its contracted distributors. A usage fee may be charged depending on the nature of the proposed use. For works of art from the Organization's collection reproduced on the Website and its subdomains, in their entirety or as details, please obtain digital photographic images from our Search the Collection feature or contact digitalassets@buffaloakg.org. For works of art from other museums or institutions reproduced on the Website and its subdomains, contact the institution credited in the work's caption directly. For all other images on the Website and its subdomains, and for any text excerpts, contact the Organization at info@buffaloakg.org. Privacy

Protecting the privacy of visitors is a priority for the Organization. The Organization's information-gathering practices are governed by its Privacy Policy. Children under the age of 13 are required to obtain permission from an adult before submitting personally identifiable information or other content to the Website.

Links to Third Party Sites

The Organization has not reviewed all of the sites linked to or from the Website and its subdomains and is not responsible for the content or privacy policies of any off-site pages or other sites linked to or from the Website and its subdomains. The Organization provides these links as a convenience, and linking to any off-site pages or other sites is at the user's own risk. A link does not imply endorsement of or affiliation with the linked site by the Organization.

Disclaimer

The Organization assumes no responsibility, and shall not be liable for, any damages to a visitor’s computer equipment or other property resulting from use of the Website and its subdomains.

Limitation of Liability

NEITHER THE ORGANIZATION, ITS AFFILIATES, TRUSTEES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS SHALL HAVE ANY LIABILITY FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, COMPENSATORY, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES (EVEN IF THE ORGANIZATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING FROM OR RELATED TO USE OF THE WEBSITE, CONTENT, AND/OR COMPILATION.

Indemnity

The visitor agrees to indemnify, defend, and hold the Organization and its respective supervisors, directors, officers, agents, and employees harmless from all claims, causes, allegations, costs, expenses, fees (including reasonable attorneys' fees), judgments, liabilities, losses, and damages arising from or relating to the visitor’s use of or operation of the Website or any of its Content.
