Images Available Under Fair Use

The Buffalo AKG has also made certain non–public domain images available for display and download under fair use as defined by United States copyright laws. To find and download these images, please visit our Search the Collection feature and check “With Images.” Select a specific artwork for a display image and a link to download a low-resolution digital photograph. These images can be downloaded and used for non-commercial, personal, and educational use (including scholarly publishing). If an artwork or a digital image is protected by copyright, you must cite the relevant copyright information (which is clearly displayed under the image, if known) when using the image and comply with all other terms or restrictions that may be applicable to that material. It is your responsibility, before use, to verify or accept any rights information provided as well as to obtain any additional permission or clearances that may be required for works protected by copyright. The most commonly used rights-management agency is Artists Rights Society (ARS). In some cases, you may need to contact the artist’s studio, gallery, estate, or representative directly.

Image Rights

The Buffalo AKG is mindful of its responsibilities concerning the intellectual property rights of others, and works to protect images of artworks that are believed to be under copyright or to have other restrictions imposed by contract or policy. While the museum makes every effort to accurately determine the rights status of artworks and images of those artworks, the information we provide on this website may not be up to date. Any statement on the public domain status of a work is made by the museum in good faith. If you have any information on the rights status of a work contrary to or in addition to the information on our website, or if you are the copyright owner and believe the website has not properly attributed your work or has used it without your authorization, please contact digitalassets@buffaloakg.org.

All visitors are encouraged to review our Terms of Use prior to any use of the images or materials on this website. Visitors are solely responsible for the download and use of any images from the museum’s website.

To request an image of an artwork that is not online or is under copyright with a third party, or to request digital files in sizes or formats other than those offered through the museum’s website, please contact one of the museum’s distributors, as outlined below. Permission for such uses is granted at the sole discretion of the museum though its distributors. 

Please have the following information available before submitting your request:

• Artist and title of the artwork
• Format desired (color or black-and-white)
• Author’s name, title, and publisher of the publication in which the work will be reproduced
• Date of publication

Requesting Images for Educational and Scholarly Use

The Buffalo AKG contributes select digital images of artworks in its collection to the Artstor Digital Library, a subscription-based image database featuring a range of images from some of the world’s leading museums, photo archives, scholars, and artists, made available for academic, educational, and scholarly use. If you are affiliated with an institution that subscribes to Artstor, you can access these images directly through Artstor’s website. If you do not have access, you can contact Artstor to request temporary access.

Requesting Images and Permissions for Commercial Use

To request digital images or permissions for commercial use, please contact Art Resource. Art Resource acts as the museum’s primary agent for the distribution and licensing of the museum’s images and will provide high-quality digital images when possible. A fee may be charged depending on the nature and type of the proposed use and the availability of the image(s) requested. All requests for new scanning or new photography are reviewed on a case-by-case basis. Upon approval, additional fees will apply. New photography requires a minimum of six weeks.

Although copyright permissions for the estate of Marisol are controlled by the Buffalo AKG, the museum asks that any interested parties please contact Artists Rights Society (ARS), which handles all reproduction and copyright clearance requests for the artist.

The museum can neither grant nor deny permission to use digital images of artworks in its collection obtained from other sources. We strongly recommend the use of the museum’s images of artworks in its collection over those from other sources.

Apart from the above, you may not suggest or imply the museum’s endorsement of your publication or project, nor use the trademarks of the Buffalo AKG Art Museum or the Buffalo Fine Arts Academy without permission.

In addition, the museum reserves any applicable rights to the photography of its facilities, installations, events, employees, and guests created or commissioned by staff members of the museum.
